An employee who already meets the conditions for old-age retirement is no longer a protected category against termination of the employment contract, however, the employer may terminate them only for a justified business reason. Article 21 of the Intervention Measures to Assist in Mitigating the Consequences of the Second Wave of the COVID-19 Epidemic (hereinafter ZIUPOPDVE) regulates the exact opposite.
Namely, Article 21 of the ZIUPOPDVE regulates the t.i. compulsory retirement, as the employer may terminate the employment contract of an employee who already meets the conditions for acquiring the right to an old-age pension without stating a substantiated business reason. However, this arrangement has provoked many divided opinions among workers, employers and the public.
Therefore, additional caution is advised in the event of dismissal under Article 21 of the ZIUPOPDVE.
